These Terms & Conditions govern the services provided by iBuildify. By engaging our services or using our website, you agree to these terms.
All services are delivered under a written agreement or proposal that outlines scope, deliverables, timelines, and fees. These Terms apply alongside any project-specific agreement, which prevails in the event of a conflict.
iBuildify retains ownership of all pre-existing tools, frameworks, processes, and methodologies. Ownership of project deliverables transfers to the client upon full payment, subject to the ownership terms below.
Clients agree to provide timely feedback, content, access, and approvals required to complete the work. Delays caused by the client may impact timelines and may incur additional fees.
Fees, payment schedules, and milestones are set out in your proposal. Invoices are payable by the stated due date. We may pause work on overdue accounts. Recurring plans renew automatically until cancelled in writing.
Due to the custom nature of our work, fees for completed work and work in progress are non-refundable. Any refund of pre-paid amounts for work not yet started is at our discretion and assessed on a case-by-case basis.
To the maximum extent permitted by law, iBuildify is not liable for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amount paid for the services giving rise to the claim.
Timelines are estimates based on agreed scope and timely client cooperation. While we work to meet all deadlines, dates are not guaranteed and may shift due to scope changes or external dependencies.
Upon full payment, the client owns the final website deliverables, including custom design and content created specifically for the project, excluding third-party assets and licensed components that remain subject to their respective licences.
Custom software developed for a client transfers to the client on full payment, excluding our reusable libraries, frameworks, and underlying tooling, which we license to the client for use within the delivered product.
Some deliverables may include content, imagery, or code generated with AI tools. The client is responsible for reviewing such outputs before use. We do not warrant that AI-generated content is free of third-party rights, and we make no guarantee of uniqueness or fitness for a particular purpose.
The parties will attempt to resolve any dispute in good faith through direct negotiation. If unresolved, disputes will be handled in accordance with the laws of the jurisdiction in which iBuildify operates.
